1. Definitions

“Client”, “You”, “Your”** refers to the person or entity using JCS Internet Solutions services.
“We”, “Us”, “Our”** refers to JCS Internet Solutions.
“Services”** refers to web hosting, domain registration, email hosting, and related internet services provided by us.

2. Acceptance of Terms

By signing up for or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must discontinue use of our services.

3. Service Terms

3.1 Services are provided on a month-to-month or annual basis unless otherwise agreed in writing.
3.2 We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
3.3 Uptime guarantees and technical support are provided as outlined in your Service Level Agreement (SLA), if applicable.

4. Client Obligations

4.1 You are responsible for all content hosted on your account.
4.2 You must not use our services for unlawful, abusive, or prohibited activities, including but not limited to:

* Sending unsolicited bulk email (“spam”).
* Hosting or distributing illegal or harmful content.

4.3 You are responsible for:

* Creating, configuring, and maintaining your own email accounts within the control panel.
* Setting appropriate mailbox size and usage limits.
* Configuring and maintaining your email accounts on your own devices or software (e.g., Outlook, Thunderbird, mobile apps).

4.4 You agree to keep your login credentials secure and notify us immediately of any unauthorized use.

5. Payments and Billing

5.1 All fees are payable in advance according to your selected billing cycle.
5.2 Failure to make payment by the due date may result in suspension or termination of services.
5.3 All prices are quoted in South African Rand (ZAR), and VAT is applied where applicable.
5.4 We reserve the right to adjust fees with 30 days’ prior notice.

6. Cancellations and Refunds

6.1 You may cancel your services at any time by providing written notice.
6.2 Refunds are governed by our Refund Policy. Domain registration fees, renewal fees, and setup costs are strictly non-refundable.
6.3 We may suspend or terminate accounts immediately, with or without notice, if these Terms are violated.

7. Domain Registrations

7.1 Domains are registered subject to the rules and terms of the relevant domain registry.
7.2 You are responsible for ensuring your contact details remain accurate and for making timely payments to avoid domain expiry.
7.3 We are not liable for loss of domains due to late payments, inaccurate contact information, or actions of the registry.

8. Limitation of Liability

8.1 We are not liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use our services.
8.2 Our maximum liability is limited to the total fees paid by you for the affected services during the three (3) months preceding the incident giving rise to the claim.

9. Privacy and Data Protection

9.1 We respect your privacy and will handle your personal data in compliance with the Protection of Personal Information Act (POPIA).

10. Amendments

We may update these Terms from time to time. Any material changes will be communicated to you in advance. Continued use of our services after such changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms and Conditions are governed by and construed under the laws of the Republic of South Africa. Any disputes will fall under the exclusive jurisdiction of the South African courts.
